Austin, MN (KROC-AM News) - A tentative plea agreement has been worked out in an Austin murder case.

A petition to plead guilty has been filed in Mower County Court in the case of Miguel Nunez. The court document indicates the 19-tear-old Sioux Falls South Dakota man has agreed to enter a guilty plea to a charge of second-degree murder charge without intent during a court hearing next week.

Nunez was originally charged with three counts of second-degree in connection with the death of 45-year-old David Harris in the early morning hours of July 5 at the victim's home in Austin. The criminal complaint alleges Nunez went to Harris's home with several other people seeking to purchase marijuana when he pulled out a gun and threatened to shoot all of the people in the house if they did not comply with his demand to hand over all of the drugs in the residence.

A witness told police that Harris was shot to death when he apparently heard the commotion allegedly created by Nunez and came out of a bedroom holding a handgun. The same witness, who told police he was shot and wounded while struggling with Nunez after the fatal shooting, also stated that Harris was able to fire back and wound Nunez before he dropped his gun and fled from the home.

He is currently being held in the Mower County Jail on conditional bail of $500,000.
