Rochester, MN (KROC-AM News) - A former senior member of the Rochester Fire Department has apparently dropped his challenge to his firing earlier this year.

City Human Resources Director Linda Hillenbrand has informed KROC-AM News that Brennan Kelly has officially resigned. Kelly was a member of the fire department for over 25 years and served as a Captain for over a decade before the Rochester Civil Service Commission, acting a recommendation from Fire Chief Erik Kerska, voted to terminate his employment in February.

The recommendation to fire Kelly centered on an emergency medical call last October involving an 11-year-old girl who was in urgent need of critical care. Kelly was accused of confronting a Gold Cross medic twice at the scene and that led to an investigation. It found Kelly’s " inappropriate comments and unprofessional behavior" amounted to an interference with the girl’s treatment. Chief Kerska also cited previous misconduct by Kelly that resulted in unpaid suspensions and reprimands.

Kelly responded by formally challenging the Fire Civil Service Commission’s action. His case was set to be heard by an arbitrator before he informed the city of his decision to resign.
