Rochester, MN (KROC-AM News)- A Rochester man has been charged in a teen sexual assault case.

The criminal complaint, filed in Olmsted County Court on Wednesday, says the young victim committed suicide. 

She was 15 years old at the time of the alleged sexual assault and suicide, the complaint says.

Court Filing: Rochester Man Charged for Sex Assault of Teen Girl For Third Time in Less Than 2 Years, Victim in Latest Case Dies by Suicide

21-year-old David Ray Servin is facing one count of third-degree criminal sexual conduct.

It’s the third time in less than two years that Servin has been charged for sexual conduct with an undergae girl, according to court records. The two cases filed prior to the new case are set to go to trial next week.

The complaint in the newly-filed sex crime case says an Olmsted County sheriff’s deputy responded to a home in Stewartville last September after Servin was seen walking out of the victim’s bedroom.  

A second person told the deputy that they suspected the victim would have evidence of being in a sexual relationship with Servin on her phone, the court document says.

The court document says the victim was not willing to tell the deputy what Servin was doing at the home and that no further action was taken.

Law enforcement was called back to the house that same day and found the victim dead by suicide. An investigator learned the victim had confided in a family member that she had been in a sexual relationship with Servin, according to the complaint.

Authorities then arrested Servin two days after the alleged sex assault for violating the conditions of his pretrial release in the prior cases by having contact with a minor, the court filing says. 

During an interview with law enforcement, Servin admitted to having a sexual relationship with the teenage girl and said the two had sex two or three days before her death, according to the complaint.

Servin has been in custody at the Olmsted County Jail since his arrest, according to jail records. Servin’s first court appearance in the new case is scheduled for this Summer.
