Rochester, MN (KROC-AM News)- An Olmsted County Judge has returned a verdict for a case involving a Rochester Police chase connected to a reported kidnapping.

The incident that led to the filing of multiple felony charges occurred in late January when Rochester Police learned that 42-year-old Roderick Malone had taken his child out of Gibbs Elementary School. 

Officers learned Malone did not have custody of the child after the school administrator reported the incident by calling 911.

After leaving the school with the child, the New Hope man was seen at the child’s mother’s home dragging her up the residence’s driveway, according to the judge’s ruling. 

At one point he opened the car door and revealed  the child sitting in the back seat to the mother, the court filing says.

Malone dragged her into the garage, bashed her head against the ground multiple times then got back into the vehicle and drove away from the home, according to the court document. 

Officers spotted Malone driving east on 55th St. Northwest in the area of Hwy. 52. Police attempted to stop the vehicle, but Malone continued driving and ran a redlight as he turned north onto 18th Ave. NW, the court document says. Part of the chase was captured on camera. 

The vehicle continued north and was finally stopped when Olmsted County Sheriff’s Deputies blocked the road just south of Hwy. 63. 

Malone was taken into custody and formally charged with Kidnapping, first-degree burglary with assault, depriving custodial rights and fleeing in a motor vehicle. 

The judge found Malone not guilty of the kidnapping charge and guilty of the three other charges last week, according to the court filing, which was posted on Tuesday. 

Malone is scheduled to be sentenced in September.
